L'Aide Juridictionnelle : une justice à deux vitesses ?

L’égalité devant la justice est un principe juridique fondamental dont l’Etat français est garant. Si la limite de fait à ce principe qu’est l’inégalité économique est en théorie compensée par l’instauration de l’aide juridictionnelle, l’égal accès à la justice est-il vraiment garanti ?

Les personnes dont les ressources sont insuffisantes pour faire valoir leurs droits en justice bénéficient d'une aide juridictionnelle (AJ)[1]. L'Etat affecte annuellement à chaque barreau une dotation pour les missions d'AJ accomplies par les avocats du barreau. L'avocat qui prête son concours à l’AJ perçoit une rétribution correspondant à un nombre d’unité de valeur (UV) par type de procédure selon un barème établi par décret (1 UV = environ 22 € hors taxes).
